Explorata, a division of Travel My Way Inc. (the agency) and its website Explorata.ca provide information to you/passenger to assist you in purchasing travel services from various suppliers. You/passenger by using this site and/or in accepting an invoice/itinerary are agreeing to accept, without modification, the terms and conditions of service and sale as set out herein and the terms and conditions of sale of the suppliers whose services you are engaging. You agree that you are aware of and understand such suppliers' terms and conditions of sale and in particular, but without limitation, those terms and conditions pertaining to cancellation. It is the responsibility of you/the passenger to review your invoice/itinerary and ensure that it is correct and reflects the requested travel arrangements.
Unless otherwise stated, once the booking process is completed, all of the services purchased from the agency or the website as described on your invoice/itinerary are non-refundable, non-transferable and cannot be changed or cancelled. Notwithstanding this, where change or cancellation is possible, you/passenger acknowledge that such change or cancellation shall require the payment of penalties which may equal the full price paid for the service being changed or cancelled as determined by the supplier of the service and, further, that the agency shall apply a service charge for assisting in the processing of the change or cancellation.
Explorata.ca provides information on an "as is" basis. In no event shall Travel My Way Inc. be liable for the accuracy, the completeness or reliability of any of the content or the data found on this site. Travel My Way Inc. and any third party providers expressly disclaim all warranties and conditions, including implied warranties and conditions of merchantability and fitness for a particular purpose. We assume no responsibility for damages to or viruses that may infect your computer equipment on account of your access to, use of, or browsing in this web site.
Travel My Way Inc. acts only as agent for the suppliers whose services are being arranged for you. These suppliers are independent parties over which we exercise no direct control. Familiarize yourself and your traveling companions with the terms and conditions of sale of the suppliers that you have chosen. If the terms and conditions of the suppliers are not found during your research and booking process, we can provide them to you. The agency assumes no responsibility for and shall not be expected, asked, or required to pay for any financial loss, personal injury, property damage, other loss, accident, delay, inconvenience, loss of employment or irregularity which you/passenger or traveling companions or group members may experience either by reason of (1) non-performance by any supplier for whatever reason; or, (2) wrongful, careless, negligent or unauthorized acts or omissions on the part of any supplier or its employees or on the part of any other party not under our control; or (3) any defect, breakdown or other failure of any aircraft, train, bus, automobile, ship, accommodation or other equipment instrumentally owned , operated or otherwise used by a supplier, or (4) terrorist activities, social or labor unrest, construction difficulties, diseases, local laws, climatic conditions, abnormal conditions or developments or any other actions, omissions or conditions outside our control.
Travel My Way Inc. shall not be responsible for any losses or damages, either directly or indirectly, due to the bankruptcy, insolvency, receivership or cessation of operations for any reason whatsoever of any supplier whose services you have engaged. Such losses include, but are not limited to, unused travel services and damages associated with delayed or cancelled return transportation. You are advised that non-Ontario suppliers are not covered by the Travel Industry Compensation Fund (TICO).
There may be different living standards and practices, and different standards and conditions with respect to the provision of utilities, services and accommodations outside Canada. Information on relevant laws and customs and documentation is contained in suppliers' brochures, website links or is obtainable through tourist offices, consulates etc. of the applicable destinations. While we have endeavored to advise you of the relevant local laws, customs and travel documentation required for your travel destination and your return to Canada, we cannot warrant the completeness or accuracy of our advice. It is your responsibility to be aware of and prepared for all legal, documentary, health and other requirements for your intended travel.
You/passenger confirm and we have relied on your confirmation that as the booking or instructing passenger, you have the authority to book travel services on behalf of the other persons named in this receipt and itinerary. You will keep our Travel Advisor informed of any changes to your travel plans or contact information. You agree to familiarize the other persons named in this receipt and itinerary with our terms and conditions and those of the suppliers whose services are being arranged.
Many of the problems for which we cannot be responsible can be insured against. We strongly suggest that you obtain appropriate insurance coverage. Do not travel out-of-country without adequate medical/health insurance coverage. Travel insurance policies offered by the agency contain exclusions, restrictions and limitations of coverage which may limit your claim. You agree that you have been advised of the availability of travel insurance coverage and have either purchased or expressly declined such insurance coverage.
Governing law
This agreement and its performance shall be governed by the laws of the province of Ontario, Canada.
Changes in the statements
Travel My Way Inc. may change these Terms and Conditions at any time without notice.
